Welcome to metavisions. These Terms of Service ("Terms") govern your use of our wellness studio services, facilities, website, and any related services provided by metavisions GmbH ("we", "us", or "our").

By accessing our facilities, using our services, or visiting our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services or facilities.

These Terms constitute a legally binding agreement between you and metavisions GmbH, a company registered in Austria with registration number 59041826.

metavisions provides wellness and fitness services including but not limited to:

• Personal training sessions
• Group fitness classes
• Wellness coaching and consultation
• Specialised fitness programmes
• Nutritional guidance and planning
• Fitness assessments and evaluations
• Use of fitness facilities and equipment

All services are subject to availability and may be modified, suspended, or discontinued at our discretion with reasonable notice.

User Obligations

By using our services, you agree to:

Health and Safety Requirements

• Provide accurate health information and disclose any medical conditions
• Follow all safety instructions and guidelines provided by our staff
• Use equipment properly and report any defects or safety concerns immediately
• Maintain appropriate personal hygiene and wear suitable workout attire
• Obtain medical clearance before participating if you have health concerns

Facility Usage

• Respect other members and staff at all times
• Follow facility rules and posted guidelines
• Clean equipment after use and return it to designated areas
• Respect facility hours and access restrictions
• Not engage in disruptive, inappropriate, or unsafe behaviour

Booking and Cancellation

• Arrive punctually for scheduled appointments
• Provide at least 24 hours notice for cancellations
• Pay all fees and charges in accordance with our pricing policies
• Notify us promptly of any changes to your contact information

Membership and Payment Terms

Payment terms and membership conditions are as follows:

Payment

• All fees must be paid in advance or as agreed upon booking
• We accept cash, bank transfer, and major credit/debit cards
• Prices are subject to change with 30 days written notice
• Late payment may result in suspension of services

Cancellation and Refunds

• Individual sessions cancelled with less than 24 hours notice may be charged in full
• Package deals and memberships are non-refundable unless required by law
• Refunds for medical reasons may be considered on a case-by-case basis
• Unused sessions may be transferred to another person with prior approval

Health and Medical Disclaimers

Important health and safety information:

• Exercise involves inherent risks of injury
• You participate in all activities at your own risk
• Our staff are fitness professionals, not medical practitioners
• Stop exercising immediately if you feel pain, dizziness, or discomfort
• Inform us immediately of any injuries or health changes

Intellectual Property

All content, materials, and intellectual property rights related to metavisions services are owned by metavisions GmbH or our licensors. This includes but is not limited to:

• Training programmes and methodologies
• Written materials, guides, and educational content
• Website content, images, and design
• metavisions branding, logos, and trademarks
• Proprietary software and applications

You may not reproduce, distribute, modify, or create derivative works of our intellectual property without express written permission. Personal use of materials provided during your training sessions is permitted for your own fitness journey only.

Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal information is governed by our Privacy Policy, which forms an integral part of these Terms.

By using our services, you consent to:

Limitation of Liability

To the fullest extent permitted by Austrian law:

Limitation of Damages

metavisions GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Personal injury beyond our reasonable control
• Damages resulting from your failure to follow instructions
• Interruption of services due to circumstances beyond our control

Our total liability for any claims arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Note: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify, defend, and hold harmless metavisions GmbH, its directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

• Your use of our services or facilities
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your negligent or wrongful conduct
• Any false or misleading information you provide

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts in Villach, Austria.

Alternative Dispute Resolution

Before initiating any legal proceedings, we encourage you to contact us directly to resolve any disputes. We are committed to working with you to find a mutually acceptable solution.

For consumer disputes, you may also have the right to use alternative dispute resolution procedures provided by Austrian consumer protection authorities.

Termination

Either party may terminate the service relationship under the following circumstances:

• You may discontinue services at any time with appropriate notice
• Cancellation policies for specific services will apply
• Refunds will be processed according to our refund policy

Termination by metavisions

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, if you:

• Breach these Terms or our facility rules
• Engage in behaviour that endangers yourself or others
• Fail to pay required fees
• Provide false or misleading information
• Engage in harassment or inappropriate conduct

Effects of Termination

Upon termination, your right to use our services will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, limitation of liability, and governing law clauses.

Force Majeure

metavisions shall not be liable for any failure or delay in performance under these Terms which is due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, or extreme weather conditions
• Government regulations, orders, or restrictions
• Public health emergencies or pandemics
• Labour strikes or disputes
• Equipment failure or utility outages beyond our control
• Other circumstances beyond our reasonable control

In such cases, we will make reasonable efforts to resume normal operations as soon as possible and may offer alternative arrangements or credits for affected services.

Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole.

Such provisions shall be deleted without affecting the remaining provisions of these Terms, and the remaining provisions shall continue to be valid and enforceable.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you of material changes via email or other communication methods
• Provide reasonable notice before changes take effect
